City or county permits for a pole barn barndominium slab in New Smyrna Beach
Volusia County took over permitting, code enforcement and hearings for unincorporated properties around the city on July 1, 2022, under an Interlocal Service Boundary Agreement. Inside the city, Building and Inspections works under the 2023 Florida Building Code, 8th Edition. Every application goes through its EnerGov self-service portal.
The city's FAQ asks owners to let the contractor pull the permit in the contractor's name. It calls a contractor who asks you to pull a homeowner permit a sign of an unlicensed operator. A permit also expires after 180 days if no required inspection has been approved, so hold off filing until your slab date is real. We pull the permit when your job needs one. Not sure which side of the line your lot is on? Ask the city first. Then read the Volusia County concrete permit guide for the county path.
The coastal setback line: where the city bans slabs, sheds and pavers
The city's Coastal Construction Setback Line sits in the same place as the state's control line. LDR 703.02 bans three things seaward of it: any part of a principal building, accessory structures "including but not limited to decks, patios, garages, sheds, and gazebos," and hardscape like pavers and planters. Dune walkovers and some seawalls and fences are exempt, with a building permit.
For anything else seaward, you'd ask the planning and zoning board for a variance. The board has to deny it if any listed criterion goes unmet. About 10.4 km of the state line runs inside the city, a longer stretch than Daytona Beach or Ormond Beach has. FDEP lists an erosion area from R160.8 to R207.8 along the Bethune Beach side. On a beachfront parcel, a barn or barndominium floor starts as a variance request. Our beachside concrete guide walks through the review.
